Arbitral Tribunal allows Hero MotoCorp to use the trademark 'Hero' for its Electric Vehicles

An Arbitration Tribunal recently allowed Hero MotoCorp to use the trademark 'Hero' for its electric vehicle while adjudicating the trademark infringement battle between electric two-wheeler maker 'Hero Electric' and Hero MotoCorp.

The panel comprising of former Chief Justice of India Dipak Misra and retired judges Indu Malhotra and Indermeet Kaur were of the opinion that Hero MotoCorp had asserted its intention to use 'Hero' for its business of Electric Vehicles since 2012, and the company has invested a considerable amount of Rs. 400 Crores for its commercial launch. The company was set to launch its EVs under the name 'Vida – powered by Hero'.

The Tribunal rejected the arguments put forth by Hero Electric and noted that Hero MotoCorp had spent more than Rs 7,000 crore for enhancing the goodwill and reputation of the brand 'Hero' in the past 10 years as against only Rs 65 crore invested by the Naveen Munjal Group led Hero Electric in the promotion of 'Hero Electric'.

Naveen Munjal, current chairman of Hero Electric and Hero Cycles, has been engaged in a legal battle with his uncle and Hero MotoCorp chairman Pawan Munjal, claiming that his family had exclusive ownership rights of the brand 'Hero' for eco-friendly products.

The Tribunal thereby dismissed the present appeal and allowed Hero MotoCorp to use the trademark 'Hero'.
