Dutch Data Protection Authority Penalizes Clearview AI For Illegal Facial Recognition Database
The American software company termed the decision unlawful
The Dutch Data Protection Authority (DDPA) has slapped a fine of 30.5 million euros ($33.7 million) on US facial recognition company Clearview Al for building illegal records. A penalty of 5 million euros has also been imposed for non-compliance with rules.
However, Jack Mulcaire, the company’s chief legal officer stated, "Clearview AI does not have a place of business in the Netherlands or the European Union, it does not have any customers in the Netherlands or the EU.”
He added, "The company does not undertake any activities that would otherwise mean it is subject to the EU's General Data Protection Regulation (GDPR). This decision is unlawful, devoid of due process, and is unenforceable."
In a statement, DPA clarified that Clearview had not objected to its decision and would therefore be unable to appeal against the fine.
DPA Chairman Aleid Wolfsen remarked, "Facial recognition is a highly intrusive technology, that you cannot simply unleash on anyone in the world.”
