Philips files patent infringement case against Xiaomi

Philips moves Delhi High Court seeking interim order for banning sales of Xiaomi's handsets/mobiles

Koninklijke Philips N. V. (the plaintiff) filed a patent infringement case in the Delhi High Court against Xiaomi Inc. &Ors. (the defendants). The dispute arose between the parties regarding the patents related to UMTS enhancement (HSPA, HSPA+) and LTE technologies. The plaintiff alleged that the defendant had infringed on three of its patents.

The plaintiff sought an ad-interim injunction order against the defendants for seeking restraint of manufacturing/assembling, importing, selling, offering for sale, advertising including through their and third party websites, mobile phones and any future or other devices or models, that include UMTS enhancement (HSPA, HSPA+) and LTE technologies and result in infringement of any of the patents of the plaintiff.

An ad-interim injunction order was also sought by the plaintiff, whereby it requested the High Court to grant a direction to the Central Board of Excise and Customs to issue appropriate instructions to custom authorities at every port including airports in India not to allow the import of mobile handsets by the Defendants or their agents/affiliates/sister concerns/subsidiaries that include UMTS enhancement (HSPA, HSPA+) or LTE technologies and result in infringement of any of the patents of the plaintiff.

Justice V Kameswar Rao further directed the defendants to maintain Rs.1,000 crores in their bank accounts that are operational in India till the next date of hearing. The defendants were further asked to file the details by 2 December 2020, of their bank accounts that are operational in India that has an amount of Rs 1,000 crores. The defendants were given a timeline of four weeks to file the written statement, and the next date of hearing of this matter is 18 January 2021.
