Khaitan & Co Advised Liquor Vend Allottees Before The Supreme Court Of India

Khaitan & Co successfully strategized, advised, and appeared on behalf of successful liquor vend allottees before the Supreme Court of India in a Special Leave Petition challenging the Interim Order passed by the High Court of Punjab and Haryana.

The Supreme Court set aside the High Court’s ‘status quo’ Order, which had prevented 97 liquor vends, allotted through e-auction under the Excise Policy 2025-2026, from commencing operations on April 1, 2025. The Order had led to a complete standstill in liquor sales and loss of excise revenue.

The Court accepted the submissions that the High Court had failed to record any satisfaction regarding the prerequisites for granting interim relief. It observed that, while it would not have interfered had the High Court recorded even brief reasons, the absence of any recorded satisfaction warranted intervention.

The legal team on behalf of the liquor allottees, led by Senior Advocate Dr. Abhishek Manu Singhvi, and supported by Advocates Aseem Chaturvedi and Arsh Alok, highlighted procedural infirmities in the High Court’s approach. Dr. Singhvi submitted that the High Court had failed to record any satisfaction regarding the existence of a prima facie case, balance of convenience, and irreparable injury, and that the catastrophic impact of the Order merited intervention by the Hon’ble Supreme Court.
