CCI Withdraws Flipkart Antitrust Probe Report After Xiaomi’s Protest

Earlier, Apple’s document was revoked after a complaint that its commercial secrets were disclosed to some entities

The Competition Commission of India (CCI) has recalled its investigation report into competition law breaches by e-commerce giant Walmart's Flipkart.

The move came after China's Xiaomi complained to the Commission that the report mentioning Flipkart (of Walmart), some of its sellers, and smartphone players contained commercial secrets, including model-wise sales that were sensitive information.

It was reported that the CCI told recipients of the Flipkart report to destroy it and give an undertaking to avoid further distribution.

However, India's antitrust body stated that some data, and information was inadvertently included in the report. It provided the parties a new report without mentioning the changes.

In August, the CCI recalled an antitrust report on Apple after the company complained that its commercial secrets were disclosed to some entities.

In a lengthy investigation that began in 2020, the Commission detected that Flipkart and its rival Amazon, gave preference to select sellers and prioritized certain listings. They colluded with companies including Xiaomi, Samsung and Vivo to launch phones exclusively on their websites.

However, the investigation was put on hold after Vivo and other online sellers of the two e-commerce companies challenged their inclusion in the probe and obtained injunctions from the court.
