Bennett Coleman's Trademark Suit Gets Disposed With Nominal Damages At Rs. 1; Parties Enter Into Settlement
A Delhi Court in its decision on November 9 disposed of a suit moved by Bennett Coleman & Co, against entities running business of gifting accessories, gifts, etc. under the alleged use of Trademark similar to "Times of India", "Economic Times" belonging to the plaintiff, with nominal damages of Rs. 1. District Judge Man Mohan Sharma, Tis Hazari Court, in view of the settlement arrived at between the two parties, ordered,
"The terms of the respective applications and Settlement Agreements appear to be within the four corners of law. Therefore, the settlement between the plaintiff and defendant nos. 1, 2, 7 and 11 respectively is accepted. A consent decree is accordingly passed vis-a-vis the plaintiff and defendant nos. 1, 2, 7 and 11 and the respective settlement agreements, which for the purpose of identification are Ex. X-5, X-6, X-7 and X-8 are respectively and made an integral part of this order and the decree."
