Delhi High Court Grants Interim Relief To ‘House Of Masaba’ In Trademark Infringement Case

The Delhi High Court has granted interim relief to Masaba Gupta’s clothing and cosmetics brand, House of Masaba, in a trademark infringement suit filed against entities using similar marks.

Justice Amit Bansal issued summons in the case and restrained the defendant from using the trademarks “MASABA” and “MASABA COUTURE,” along with Instagram handles “masabacoutureofficial.co” and “masabacouture.in,” or any other name deceptively similar to House of Masaba’s registered trademarks.

“Accordingly, it is directed that the defendants, their proprietor, partners, principal officers, servants, retailers, agents, and all others acting on their behalf are restrained from using the impugned trademarks or any mark similar to the plaintiff’s registered trademarks,” the Court ordered.

The brand approached the High Court after discovering Instagram pages selling identical goods and services under infringing names. The Court found that the defendant was misleading consumers by falsely associating with House of Masaba, thereby diluting its trademark’s distinctiveness.

Additionally, the Court directed Instagram to take down the defendant’s accounts and provide the plaintiff with the complete contact details of the infringing parties.

The matter is scheduled for its next hearing on July 23.
