RERA Restricts Buildox From Advertising And Selling Units in Hyderabad’s Hafeezpet Project
Orders it to deactivate the scheme’s promotion on Facebook
The Telangana bench of the Real Estate Regulatory Authority (RERA) has restrained Buildox Private Limited from advertising and selling its proposed Hafeezpet, Hyderabad project until the disposal of the complaint filed against it for violating Sections 3 and 4 of the Real Estate (Regulation and Development) Act, 2016, on advertising an unregistered project.
The complainant filed a case against Buildox (respondent), alleging that it violated Sections 3 and 4 of the Act by advertising the unregistered project. He alleged that the respondent collected a significant sum from homebuyers in the project’s name despite lacking the land’s title and agreement with the original landowners. He added that the land fell under a ‘prohibited category’ and the matter was pending before the Supreme Court.
Based on the facts, the complainant approached the Telangana RERA seeking interim direction.
The bench comprising Justice Dr. N Satyanarayana (chairperson), K. Srinivasa Rao (member) and Laxmi Narayana Jannu (member) restrained the respondent from marketing, advertising, and selling the proposed project until the final disposal of the complaint. The respondent was also ordered to deactivate the project’s advertisement on Facebook.
The real estate authority further directed the respondent to submit the company's and its group entities’ bank account statements within a week.
