NCLT Notice To SpiceJet As Sabarmati Aviation And JetAir 17 File Insolvency Pleas
Several petitions against the low-cost airline are pending with the tribunals
The National Company Law Tribunal (NCLT) has served a notice to SpiceJet regarding Sabarmati Aviation's (operational creditor’s) plea and sought documentation from another complainant JetAir 17, which claimed the airline owed it USD27 million in lease payments.
However, SpiceJet argued JetAir's claims, stating they lacked a direct lease agreement.
JetAir, an Irish company, operates within the renting and leasing of air passenger transport equipment industry.
Representing SpiceJet, Senior Advocate Krishnendu Datta submitted that a reply would be filed over Sabarmati’s plea. But he opposed JetAir’s contention that the claims were disputed.
Datta added that JetAir was claiming the dues through Wilmington Trust, which leased planes to SpiceJet. However, no documents were presented to prove JetAir’s inheritance.
While representing JetAir, advocate Kunal Tandon contended that the low-cost carrier owed it over USD27 million and Wilmington had transferred its interest in the lease with SpiceJet to JetAir, after which the claim was filed.
The NCLT had recently issued notices to SpiceJet over a plea by Techjockey Infotech (operational creditor), claiming a default of Rs.1.2 crore against software services availed by the air carrier.
Later, the tribunal issued notices to the airline over the pleas of aircraft lessor Falgu Aviation Leasing and Aviator ML 29641.
SpiceJet has also faced insolvency petitions from creditors, including Willis Lease, Aircastle Ireland Ltd, Wilmington and Celestial Aviation at the NCLT and the National Company Law Appellate Tribunal (NCLAT), several of which are pending.
