Khaitan & Co Represented Torrent Power In Gun-Jumping Proceedings Before CCI
Khaitan & Co advised, represented and defended Torrent Power Limited (“TPL”) in a substantive Gun jumping proceeding before the Competition Commission of India (“CCI”) in relation to TPL’s acquisition of 51% shareholding in Dadra and Nagar Haveli and Daman and Diu Power Distribution Corporation Limited.
In an unprecedented decision, the CCI while recording a finding of substantive gun-jumping, imposed no penalty on TPL by recognizing significant mitigating factors.
This marks a rare departure from the CCI's established precedents, where the CCI has consistently penalised parties for substantive Gun jumping.
TPL was represented at Khaitan & Co by Manas Kumar Chaudhuri (Partner), Pranjal Prateek (Partner), Soham Banerjee (Principal Associate) and Nilav Banerjee (Senior Associate).
The core team was involved in advising TPL and handling of the matter including strategizing, researching, drafting, and appearing before the Competition Commission of India.
