Federal Trade Commission Sues PepsiCo For Special Discounts To Walmart
The lawsuit alleged that the soft drink manufacturer violated the Robinson-Patman Act
The US Federal Trade Commission (FTC) has sued PepsiCo for offering preferential pricing to a large retailer (presumably Walmart).
The Commission stated that the high consumer prices disadvantaged other retailers, including large grocery chains and independent convenience stores.
However, PepsiCo retorted, “We strongly dispute the FTC's allegations and the partisan manner in which the suit was filed.”
The lawsuit in New York alleged that the soft drink manufacturer violated the Robinson-Patman Act, a law that largely remained unenforced for decades by the federal government.
Lina Khan, the outgoing Chairperson of FTC remarked, "The FTC's action will help ensure all grocers and other businesses - no matter the size - can get a fair shake and compete on the merits of their skill, efficiency, and talent.”
The FTC's two Republican commissioners, including Andrew Ferguson, who will chair the commission after President-elect Donald Trump takes office, voted against the case.
