Geeta Luthra is Senior Advocate of Supreme Court of India. She holds LL.M (Masters in Law) and M. Phil. in International Relations degree from the University of Cambridge, UK. She has been practicing law since 1980, in the Supreme Court of India and various High Courts of India. She is the Vice President of the Indian Council of Arbitration FICCI, member, ICC India Chapter Core Committee, member, LawAsia and International Academy of Family Lawyers. She is also a member of the Women’s White Collar Defense Association (WWCDA) and has served as a sole arbitrator in many cases of domestic and international arbitration. Being a Senior Advocate, she has argued/represented various Public Sector Units and Private Companies in arbitral disputes. She has appeared as a counsel in several landmark cases and has expertise in myriad facets of law, including Criminal Law, Constitutional Law, Arbitration Law, Human Rights, Economic Offences under the Prevention of Money Laundering, PMLA Act, Benami transactions and other criminal and appellate remedies before the adjudicating PMLA authorities. She has also argued matters relating to insolvency bankruptcy Courts in the NCLT and NCLAT.
Special Counsel in several leading environmental matters in the Supreme Court for Delhi Govt, she is notably known as “Quiet flows the maili Yamuna” for cleaning Yamuna. Ms. Luthra was also a Special Counsel for the Delhi Government in Supreme Court of India in MC Mehta for matters pertaining to Water Pollution including installing Sewage Treatment Plants, Effluent Water Treatment Plants and Acquisition of Land for the said purpose. She has also been engaged as a Counsel in mining and infrastructure related issues at National Green Tribunal (NGT), Delhi. She has been a speaker at various international fora and has spoken on various burning issues like the Criminal Justice System, recent amendments in the Arbitration and Conciliation Act 1996, on the need for Institutional Arbitration, Gender Rights in Employment and Migration, changes in Rape Laws. She has attended various Law Asia conferences and delivered lectures at George Washington, USA and several other international fora, at University College, London, UK and on the Rights of Transgenders at SOAS University London UK (The School of Oriental and African Studies).
Ms. Luthra is present Additional Advocate General for Haryana in the Supreme Court of India and Special Senior Counsel at Supreme Court of India since 2013 and Senior Counsel for Union of India Panel since 2014. Ms. Luthra has also served as Standing Counsel for Union of India at the Delhi High Court from 1999 till 2004 and also been a Special Standing Counsel, for Land Acquisition Department from 2005 till 2008 and have done numerous Arbitrations for the Government for properties requisitioned by the Government of India.
Ms. Luthra has been engaged as an arguing Counsel in Leading Judgements in regards to rights of Husband and Wife in Hindu Laws, right of maintenance, application of various Acts that govern the rights in HUF (Hindu Undivided Family) like Hindu Succession Act, Indian Succession Act, Hindu Adoption and Maintenance Act. She has been involved as a Counsel in several cases relating to bails in offences against women, right to women to claim maintenance or properties which have been devolved upon the Husband from his ancestors. Many such judgements have been reported in Law Journals.
Ms Luthra has a lead judgement on the right to employment of transgender in the para military forces in India on grounds of discrimination. She has also argued matters regarding rights of woman tribal to property in view of Article 15 of the Constitution of India. She was engaged as Special Senior Counsel for the Delhi Government in a matter wherein the Head of an academic institution was suspended/removal for sexual harassment at workplace. Ms. Luthra has also argued several matters for Union of India and Govt. of National Capital Territory of Delhi involving State Police and Customs and Excise Matters. Also, served as a Special Standing Counsel for the Union of India in several Environmental Matters.
