DSK Legal represented POSCO Group and DCM Ltd.
DSK Legal represented the POSCO Group - Korean producer/ exporters, and DCM Ltd. before the Directorate General of Trade Remedies ('DGTR') in the anti-dumping investigation concerning imports of Electrogalvanized ('EG') Steel originating in or exported from Korea RP, Japan and Singapore.
The present application was filed by M/s American Precoat Speciality Private Limited ('Domestic Industry/ DI') before the DGTR, seeking initiation of the extant anti-dumping investigation. It was alleged that dumped imports of EG Steel from the subject countries were causing material retardation to the establishment of the DI. The DGTR initiated the investigation to determine the existence, degree, and effect of the alleged dumping of EG Steel from the subject countries into India.
The DSK team filed exporter questionnaire responses, written submissions and presented arguments on behalf of POSCO group and DCM Ltd. As a result, DGTR recorded a negative dumping margin and accordingly recommended a 'NIL' rate of duty for the PSOCO group. The representations also ensured that the entirety of exports from DCM Ltd. is excluded from the scope of the product under investigation, as these were not 'like products'.
Thus, pursuant to the decision of the DGTR, POSCO group and DCM Ltd will continue to enjoy full market access in India for EG Steel, as their exports will not attract anti-dumping duty.
