In a recent legal victory, Chandhiok & Mahajan, Advocates & Solicitors (C&M), has Successfully Represents Patna Highway Projects Limited before the Patna High Court. The case involved a dispute concerning the legality of GST assessment orders and demands issued by the Bihar GST department subsequent to the approval of the resolution plan.
The Court deliberated on the intricate relationship between the Insolvency and Bankruptcy Code, 2016, and the authority of the GST department to issue assessment orders and raise demands. Chandhiok & Mahajan presented compelling arguments on behalf of Patna Highway Projects Limited, ultimately leading to the court's decision to quash the assessment orders and demands.
Crucially, the Court relied on precedents set forth by the Supreme Court, particularly citing judgments in cases such as Ghanshyam Mishra, Essar, and Ruchi Soya. Notably, the Court made a clear distinction from the judgment of Rainbow Papers, which had been referenced by the GST department.
