Supreme Court transfers 24 antitrust cases against Amazon and Flipkart to Karnataka High Court following CCI’s plea
On a plea by the Competition Commission of India (CCI), the Supreme Court has ruled that all 24 cases pending in various high courts related to the alleged anti-competitive practices by e- commerce giants Amazon and Flipkart, should be transferred to the Karnataka High Court.
In 2020, the CCI found prima facie merit in Delhi Vyapar Sangh's allegations of the Competition Act, 2002 violations by Amazon and Flipkart relating to the sale and purchase of mobile phones. It alleged that the e-commerce companies indulged in exclusive arrangements, deep discounts and preferential listings.
The CCI ordered an investigation by the Director General. However, the two companies challenged the order. Recently, the Karnataka High Court stayed further proceedings against Amazon, prompting all other high courts to pass similar orders.
