Meta Seeks NCLAT’s Intervention On Penalty Imposed By CCI

Meta Platforms Inc has approached the National Company Law Appellate Tribunal (NCLAT) against the order of the Competition Commission of India (CCI) imposing a Rs.213.14 crore penalty for abusing its dominant position in 2021 WhatsApp privacy policy update.
The bench comprising Justice Ashok Bhushan (Chairperson), Barun Mitra (Technical Member) and Arun Baroka (Technical Member) ordered Meta to cease anti-competitive practices and implement behavioral remedies, including restricting WhatsApp data sharing for five years.
Appearing for Meta, Senior Advocates Kapil Sibal and Mukul Rohatgi requested for an urgent hearing, considering the importance and nature of the case.
In November, the CCI penalized Meta for unfair business practices. It directed the social media major to cease-and-desist from anti-competitive practices.
Meta and WhatsApp were ordered to implement behavioral remedies within a defined timeline to address the issues. WhatsApp was barred from sharing data collected on its platform with other Meta companies or company products for advertising, for five years.
The CCI directed that sharing user data collected on WhatsApp shall not be a condition for users to access WhatsApp services in India.
