WhatsApp (owned by technology conglomerate Meta) has challenged the European Data Protection Board (EDPB) in the Court of Justice of the European Union (CJEU), which imposed a 225 million euro ($236 million) fine.
The penalty was handed out by Irish privacy watchdog in 2021 after complaints about WhatsApp's use of data. The EDPB influenced the final amount.
However, the Luxembourg-based General Court, Europe's second- highest, dismissed it and ruled that WhatsApp was not directly concerned by the EDPB, which had discretion on its final decision.
The company then appealed the CJEU, pleading that the case could affect composite administrative proceedings where a European Union body has decision-making powers.
WhatsApp’s lawyer Hans-Georg Kamann stated, "The order under appeal is flawed and unworkable. The EDPB’s decision has legal effects and is of direct concern to WhatsApp.”
