Law Secretary Dr. Rajiv Mani Hints At Compressing Timelines For Commercial Courts

The Law Secretary of the Legislative Department, Dr. Rajiv Mani has hinted at compressing timelines for commercial courts, while commenting on the rapidly evolving dispute resolution landscape in India.

Bolstered by Prime Minister Narendra Modi’s recent diplomatic efforts, the importance of efficient dispute-resolution mechanisms has come to the forefront, as the nation positions itself as an attractive destination for international investments.

Dr. Mani highlighted significant progress in commercial dispute resolution, noting a drastic reduction in timelines within the current legal framework.

He commended the applicability of the Commercial Courts Act by the Delhi High Court, describing it as exemplary and setting a benchmark for other courts.

The official disclosed that major amendments to the Arbitration and Conciliation Act (A&C), 1996 were in the offing. The changes would enhance the effectiveness of dispute resolution processes. He added that the Legislative Department planned to issue consultation papers later this year.

The Law Secretary also spoke about the growing prominence of mediation as an alternative dispute resolution method. Noting a shift in the business environment towards amicable dispute resolution practices, he emphasized the need for structured alternative mechanisms to lighten the judiciary’s burden.

Regarding the India International Arbitration Centre, which operates at arm's length from the government, Dr. Mani expressed optimism that collaboration with the center would help restore public faith in the process of arbitration.

While lauding arbitration as a hallmark of dispute resolution in the country, he expressed gratitude to the ET Legal World team for providing a platform to share views on reforming dispute resolution and litigation processes.
