Khaitan & Co advised, represented and defended Torrent Power Limited (“TPL”) in a substantive Gun jumping proceeding before the Competition Commission of India (“CCI”) in relation to TPL’s acquisition of 51% shareholding in Dadra and Nagar Haveli and Daman and Diu Power Distribution Corporation Limited.
In an unprecedented decision, the CCI while recording a finding of substantive gun-jumping, imposed no penalty on TPL by recognizing significant mitigating factors.
This marks a rare departure from the CCI's established precedents, where the CCI has consistently penalised parties for substantive Gun jumping.
