Delhi High Court issues an injunction against a YouTube channel from posting defamatory and derogatory statements against competitor.
A single-judge bench, Justice Amit Bansal, of the Delhi High Court, restrained YouTube channel "Bear & Bulls Capital" from passing any defamatory or derogatory statements against Booming Bulls Academy.
The Plaintiff, Booming Bulls Academy runs an academy that trains how to trade in the share market. Additionally, Plaintiff has a YouTube channel where the training videos are posted.
The Plaintiff contended that the Defendant, Bear & Bulls Capital also ran a competing YouTube channel.
The present issue arose when the Defendant posted a total of 8 videos posting defamatory and derogatory content which were damaging the reputation of the Plaintiff.
The Court was of the view that the video transcripts placed before the Court were prima facie defamatory and derogatory towards the Plaintiff. It was further noted that in the event the videos are not taken down, it will result in grave harm to the reputation and goodwill of the Plaintiff. As a result, the Court directed the Defendant to take down the 8 videos within two weeks former receiving the summons of the suit.
It was further opined that if an expert injunction is not granted in the present case, it will cause irreparable loss to the Plaintiff.
The Court restrained the Defendant from posting any such content on its channel till the next hearing.
