Supreme Court to follow new procedure for mentioning and listing cases from 3 July
The miscellaneous matters will now automatically be listed, while those verified on the 4th, would be listed next Friday.
The reopening of the Supreme Court on 3 July (after the ongoing summer vacation), will witness the adoption of a new process for the listing and mentioning of fresh cases before the Chief Justice of India (CJI).
The miscellaneous matters will now automatically be listed, while those verified on 4 July, will be listed next Friday.
The counsel seeking the listing of verified fresh matters (prior to the allotted dates) would now have to submit their mentioning proformas by 3 pm, to get their cases heard the next day.
For those seeking a listing on the same day, the proformas will have to be submitted by 10:30 am to the mentioned officer along with a letter of urgency.
Accordingly, the CJI would take a call during lunch hours or 'as the exigency may warrant.'
For after-notice and regular hearing matters (to be listed urgently) the counsel will have to first approach the mentioning officer with the proforma and urgency letter.
On seeking instructions from the CJI, the registrar (judicial administration) of the apex court shall notify the generated lists before the appropriate benches.
No mentioning, other than the ones in the mentioning lists, uploaded a day prior would be permitted for such matters.
Earlier, the regime would have the mentioned proformas submitted by 10:25 am for all fresh matters or those not designated to a new bench. The CJI would then hear all the mentioning 10.30 am onwards and allot the dates.
Lately, the practice meant up to 300 odd items being mentioned on some days. After notice and partially heard regular matters would be mentioned before the concerned benches.
