Supreme Court Issues Notice to HPCL in a Long Standing 34 Year's Case
The Supreme Court has issued notice to the Hindustan Petroleum Corporation Ltd. (HPCL) and one more company for defaulting in timely payment of rent for the land procured for a ten-year lease period, starting in the year 1964.
The land owner Kaur family had been fighting in lower courts since 1986. In the year 1964, Mr. Mohindersingh Balwantsingh leased his land in the Bhosari suburb to the HPCL for a ten-year-old period on a monthly rent of Rs. 400. The HPCL had sublet the premises to one B U Bhandari and both of them had defaulted for the payment of the rent. Since 1986, the aggrieved continued to file suits in the Small Causes Court to seek for an eviction of the HPCL and the other person.
However, the suit was dismissed after five years of legal proceedings. The owner of the land had approached the district court which had passed the eviction decree on the grounds that HPCL had sublet the property.
In the year 2000, HPCL and other party approached the Bombay High Court challenging the possession decree passed by the lower court. Meanwhile Mr. Mohindersingh Balwantsingh passed away and therefore his wife Mrs. Charanjit Kaur filed a writ petition with the High Court.
The appeal is currently being heard by two Supreme Court bench of judges comprising of Hon'ble Mr. Justice Sanjay Kishan Kaul and Hon'ble Mr. Justice Dinesh Maheshwari. The petitions were called for hearing on 13th October, 2020.
Further the matter is tentatively listed on 17th November, 2020.
