Jindal India Secures Injunction Against Trademark Infringement By Rawalwasia Steel

The Delhi High Court recently addressed a lawsuit filed by Jindal India Limited (the plaintiff) concerning the infringement of trademark and copyright related to the marks "JINDAL," "JINDAL with the device of map of India," and other variants.

Justice Mini Pushkarna issued directions restraining the defendant, Rawalwasia Steel Plant Private Limited, and its associated entities from manufacturing, selling, advertising, or dealing in goods bearing trademarks identical or deceptively similar to those owned by the plaintiff.

Jindal India Limited, engaged in producing and marketing goods under these trademarks since 1952, holds registered rights under the Trade Marks Act, 1999, and also claims copyright over associated artistic works. The plaintiff argued that the defendant's adoption of the trademark "HINDJAL HISAR" for galvanized and black steel tubes and pipes in early 2024 was confusingly similar and could harm their business interests.

Despite the defendant's claim of withdrawing the trademark application and non-commercial use, the plaintiff sought an injunction to prevent future use or application of these marks.

The Court acknowledged the prima facie validity of the plaintiff's case and found the balance of convenience favored granting an interim injunction. This injunction prevents the defendant and its affiliates from using, selling, advertising, or dealing in any goods bearing trademarks resembling "JINDAL," "JINDAL with the device of map of India," or similar variants. The interim measure aims to safeguard the plaintiff's rights until the legal proceedings are concluded.
