Gujarat High Court orders government to soon fill RERA posts

Questions whether the state wanted people to remain ‘remedy-less

The Gujarat High Court has directed the state government not to delay in filling vacant posts in the Real Estate Regulatory Authority (RERA) appellate tribunal.

The remarks came after Justice (retd) R M Chhaya was recently appointed chairperson of the RERA tribunal.

The high court had disposed of the PIL demanding the filling of the vacancies of chairperson and technical member lying vacant since June 2021 and September 2021, respectively.

The bench headed by the Chief Justice said the vacancies were filled only in September, and that too after the high court issued directions.

The court stated, “We are constrained to observe that there is a considerable delay by the state government in filling the posts for a period of more than two years, and it is necessary to observe that no such situation should arise in the future.”

Earlier, the court took the government to task for not expediting the appointment process and asked whether the government wanted to keep the people of Gujarat ‘remedy-less.’
