Delhi High Court seeks reply from Just Dial On Contempt of Copyright Infringement Order

The Delhi High Court (HC) on 17 March 2021, in the case titled IndiaMart Intermesh Ltd. (Plaintiff) v. Just Dial Ltd. (Defendant) has issued notice to the defendant (Just Dial Ltd. and its Managing Director) seeking their replies for infringing of a prior copyright order passed in favour of the plaintiff.

The single judge of the HC Justice Jayant Nath also directed that a senior officer of Just Dial should be personally present before it on the next date of hearing.

The factual matrix of the case is that in November 2020, the plaintiff who is the owner of the B2B discovery platform Indiamart.com had filed a copyright infringement suit against the defendant.

The plaintiff alleged that to expedite the launch of its Business-to-Business (B2B) services the defendant had deliberately copied the entire proprietary information along with classification and look and feel of the plaintiff's website.

The HC had previously passed an injunction order restraining the defendant from launching its business 'JD Mart' and using any data copied from the plaintiff's website.

The plaintiff mentioned that the defendant has violated the order of injunction passed by the Court in favour of the plaintiff. It was further submitted that even after the order of injunction the defendant had launched its stand-alone B2B platform- JD Mart, by the name and style of Jdmart.com and it has allegedly infringed the copyright of the plaintiff.

The HC has posted the matter for hearing on 15 April 2021.
