Delhi High Court restrains website from infringing on Radico Khaitan’s liquor trademarks

The Delhi High Court has restrained unknown defendants from using Radico Khaitan Limited’s liquor brand trademarks ‘Magic Moments’, ‘8 PM’, ‘Morpheus’, ‘Rampur’, and ‘Jaisalmer’.

The bench of Justice C Hari Shankar passed the order on a suit filed by Radico Khaitan alleging that some unknown people created a fake website and asked the public to invest huge amounts of money. They claimed the amount would be invested in Radico Khaitan and the investors would get huge returns.

The company also apprised the Court that a group was also created on messaging app Telegram and the defendants were seeking payment in the name of Radico Khaitan.

The Court said that a prima facie case of infringement of Radico Khaitan's registered trademark was made out. The Judge ordered the Department of Technology (DoT), Ministry of Electronics and Information Technology (MEITY) as well as Google Pay, Twitter, Telegram, and internet service providers to furnish information regarding the defendants and to suspend the website.

Advocates Anirudh Bakhru, Ayush Puri, Umang Tyagi, Vijay Laxmi Rathi, Kanav Madani, and Pragya Choudhary appeared for Radico Khaitan.
