The Delhi High Court has quashed the rejection order on the refund of Rs. 98,54,248 claimed by the petitioner, Richie Rich Exim Solutions under the Goods and Services Tax (GST) Rules, 2017 violations. The respondent had rejected the refund claim on the ground that its supplier had been reported as 'risky.'
Justice Rajiv Shakdher and Justice Poonam A Bamba observed that the respondent had failed to demonstrate that a date had been fixed for the grant of a personal hearing to the petitioner.
The two-judge bench ruled that the impugned order passed in the petitioner's refund application under the GST Rules was flawed. It gave no reasons why the refund was neither admissible nor payable.
