Delhi High Court Issues John Doe Order To Protect Razorpay Against Trademark Infringement

Razorpay, India's leading omnichannel payments and banking platform for businesses, has secured a John Doe Order from the Delhi High Court to protect its customers and brand identity from financial fraud. Effective immediately, this order mandates Facebook, WhatsApp, and Telegram to suspend accounts that infringe on Razorpay's trademarks and engage in fraudulent activities.

In recent times, cybercriminals have increasingly impersonated reputable entities like Razorpay to deceive individuals into fraudulent schemes. The company took legal action against unknown individuals who misrepresented themselves as recruiters from Razorpay, offering fictitious part-time jobs via platforms such as WhatsApp, Facebook, and Telegram.

The Delhi High Court recognized a prima facie case in favor of Razorpay, issuing an order to prohibit unauthorized use of the "Razorpay" trademark. This measure aims to prevent financial scams targeting the public. Razorpay has also issued a disclaimer on its website to warn against such fraudulent activities.

Shivli Katyayan, Razorpay's Head of Legal, emphasized the company's commitment to customer safety and trust. She stated, "At Razorpay, the safety of our customers is paramount. We value their trust deeply and take it seriously." Katyayan highlighted Razorpay's ongoing efforts to enhance security through infrastructure updates and rigorous protocols, reaffirming their dedication to transparency and accountability.

The court's directive includes several critical actions:

Domain Name Suspension: Domain name registrars are ordered to block or suspend access to domain names used by fraudulent entities.

Account Blocking: WhatsApp and Telegram must block channels or accounts associated with the violators, providing necessary subscriber information.

Bank Account Freezing: Banks are directed to freeze or suspend operations of accounts linked to fraudsters.

UPI ID Suspension: The National Payments Corporation of India (NPCI) is instructed to suspend or disable UPI IDs involved in financial scams.

Beyond legal measures, Razorpay has enhanced its compliance initiatives, recently achieving the 'System and Organization Control 3' certification. This certification underscores Razorpay's robust data processing protocols and commitment to maintaining high standards of security and regulatory compliance in the fintech industry.
