In a recent development, Dabur India Limited and Dhruv Rathee have reached a mutual agreement to settle their ongoing legal dispute in an 'amicable' manner. The disagreement stemmed from Dabur's objections to references made by Rathee in his video regarding their 'REAL' juice product by Dabur India Limited. Dabur asserted claims that these references disparaged their trademarks, infringed upon their copyright, had the potential to mislead viewers, and might negatively impact their brand image.
In a recent development before Justice Arindam Mukherjee of the Calcutta High Court, Rathee proposed a settlement to address the concerns raised by Dabur. He agreed to either blur or replace images resembling Dabur's 'Real' juice packaging in the contested video while preserving his rights to freedom of speech and expression and making a fair comment.
During proceedings on February 29, 2024, Rathee put forward this proposal, echoing an earlier suggestion made in a prior hearing. Responding to this proposal, Dabur India Limited submitted a letter on the same day detailing various measures, including a request to refrain from linking 'Packeted Juice' with type II diabetes. However, Rathee maintained his stance on discussing other brands of packaged fruit juices.
Following negotiations, the court order dated June 18, 2024, reflected Rathee's proposal to blur or substitute the packaging resembling Dabur's 'REAL' juice with generic fruit juice packaging in the disputed video. This proposal was initially conveyed via email on March 15, 2024, and subsequently conditionally accepted by Dabur India Limited on March 19, 2024.
The agreement was finalized when Rathee's legal team submitted a modified version of the video on June 12, 2024, featuring the agreed-upon generic packaging. Dabur India Limited consented to these changes, permitting the video to be uploaded, published, or broadcasted without any references to Dabur's trademarks, copyright, labels, packaging, or advertisements associated with the 'Real' brand.
As a result, the Calcutta High Court has resolved the case and all related applications in line with the settlement reached between Dabur India Limited and Rathee.
