Court jolt for Samsung India in trademark dispute case

A Bengaluru Court has restrained Samsung India from using the Registered Trademark through an ex-parte injunction

A Bengaluru City Court has restrained the South Korean electronic giant-owned Samsung India from using the registered trademark 'Concierge'.

The City Civil Court at Bengaluru issued an interim order in this regard.

"Issue ex-parte ad-interim injunction against Samsung restraining them, their agents, servants or any persons claiming through or under them in any manner whatsoever, whether directly or indirectly, from illegally using the mark 'CONCIERGE' belonging to Lesconcierges, till next date of hearing," read the ex-parte order.

Samsung India using the trademark was challenged by Dipali Sikand, founder of Lesconcierges Services Pvt Ltd and Club Concierge Services (India) Pvt Ltd. She has sued Samsung India for infringement of their trademark 'Concierge' which is duly registered and owned by her.

"Though there is a prima facie case against the defendants for it to pass an ex-parte injunction order, the defendants ought to be heard before the same," the Court noted.

The petitioner claimed that Samsung India was misusing the Concierge trademark in various brochures, publicity material and advertisements in a President's club, which is a loyalty program for dealers and distributors of Samsung.

The petitioner has further claimed that Samsung India was misusing the goodwill and reputation of their self-established spectrum in the market.

The matter will come up for further hearing on 5 August.
