Squire Patton Boggs has advised David Mansfield and Matthew Donnelly, the partners at Deloitte, in their capacity as joint liquidators of the formerly publicly listed company Vietnam Industrial Investments Ltd in a series of cross-border transactions of key assets in Vietnam.
The law firm also acted alongside the liquidators’ appointed controller Cosimo Borrelli, the co-head of the global restructuring practice and a leading restructuring and insolvency practitioner at Kroll in Asia and the Caribbean.
The transactions involved various dealings with the Hanoi-based VN Steel Corporation, Vietnam’s leading steel manufacturing and trading enterprise.
Before the transaction, the team advised and represented the liquidators in successfully navigating the judicial processes, including proceedings in the Supreme Court of New South Wales, a scheme of arrangement in the High Court of Singapore and enforcement proceedings in Vietnam’s District Court of Haiphong.
Commenting on the development, Masi Zaki, the restructuring partner at Squire Patton Boggs stated, “The successful completion of the cross-border change in control and divestment transactions and the associated court processes demonstrates the capabilities of our team in dealing with stakeholders across key APAC jurisdictions, including Australia, Singapore, Hong Kong, Malaysia and Vietnam.”
The Squire Patton Boggs team was led from Sydney by Masi Zaki, who was supported by senior associate Kate Spratt and financial services partner Hai-dang Nguyen.
