Khaitan & Co Represented Marico in Securing Interim Injunction Against Alpino Health Foods
Khaitan & Co successfully represented Marico Limited in a suit against Alpino Health Foods Private Limited ("Alpino") before the Delhi High Court. The firm secured an interim injunction against Alpino, preventing them from causing generic disparagement of ‘oats’ as a food category.
The injunction was granted in response to Alpino's advertisement campaign, which consisted of 28 advertisements, including an audio-visual advertisement, social media posts, and a write-up on Alpino's website.
Khaitan & Co were able to successfully establish before the Delhi High Court that the advertisement campaign of Alpino was causing generic disparagement of oats as a food category and consequently of the Client's oats under the brand "Saffola’.
The Delhi High Court was therefore pleased to restrain Alpino from publishing in any manner, its impugned advertisement campaign or any other advertisement causing generic disparagement of ‘oats’ as a food category.
